CONTEST RULES
The contest is only open to individuals who are at least 18 years old at time of entry (a parent or guardian may submit an entry for a minor who is at least 14 years old). By entering or participating in the contest, you agree to be bound by these rules and the decisions of Sullimak Entertainment, LLC (‘Wampus Cats’) which are binding and final on all matters related to this contest, including, without limitation, interpretation of the rules.
How to Enter- Submit a mascot name idea through the appropriate form on this website. You must include with your entry your full name, address and email address. Limit of three entries per person.
Submission Guidelines- The Submission must be the original work/idea of the entrant & not previously published. Submissions must not infringe on the intellectual property rights of another, nor can they be confusingly similar. Submission must not have been previously submitted in any other contest. Submissions must be family-friendly.
Intellectual Property- Entrant, upon submission of the Submission, irrevocably grants to Sullimak Entertainment, LLC, and each of its licensees, successors and assigns, the non-exclusive, perpetual, royalty-free license & right to use and otherwise exploit the Submission, in whole or in part, in any manner or medium now or hereafter known or devised, throughout the universe, including, without limitation, the right to display, reproduce, recreate, record, perform, exhibit, distribute, copy, edit, change, modify, add to, subtract from, re-title & adapt the same, to combine it with other material & otherwise use & exploit it without having to give any compensation or attribution to entrant or any third party, except for the awarding of the prize to the Winner in this Contest. Entrants agree that they shall not make, and shall not permit, any other public use, display or distribution of their Submission, and they shall maintain all rights without encumbrances so that, if Wampus Cats desire, entrants can assign all rights in & to Submissions if selected as the Winner. Disco Turkeys, and each of its successors, assigns & licensees, will have the right to make unlimited derivative works of Submissions, to assign or transfer any or all of Wampus Cats’ granted rights & to grant unlimited, multiple-level sublicenses. Without limiting the forgoing, Wampus Cats will have the right to use the Submissions submitted as part of the Contest, and all images, text & materials included or depicted therein (if any), in any merchandising, advertising, marketing, promotion or for any other commercial or non-commercial purpose. Entrants agree that Disco Turkeys shall have the sole discretion in determining the extent & manner of use of Submissions & are not obligated to use any Submission; provided, however, any Submission may be utilized by Wampus Cats as an actual product name that is sold and distributed to the public, and in such event, entrant’s only right shall be the receipt of 4 tickets to the first home game and the throwing out of a ceremonial first pitch.
Each entrant acknowledges that Submissions are not being submitted in confidence or in trust and that no confidential or fiduciary relationship is intended or created. Entrant acknowledges that Wampus Cats & other entrants may have created ideas & concepts contained in their Submissions that may have familiarities or similarities to his/her own Submission, and that he/she will not be entitled to any compensation or right to negotiate with the Contest Entities because of these familiarities or similarities or if the Submission was generic or included generic elements. Nothing shall create an implied or express contract to compensate entrants for their Submissions. There is no obligation for any Contest Entity to pay or otherwise compensate entrants for any of their ideas or materials in any communications with Wampus Cats whatsoever. Submissions are not confidential & the Contest Entities’ only obligations to entrants regarding Submissions are as specifically set forth in these Official Rules.
Determining the Winner- After the conclusion of the Entry Period, each Submission will be reviewed by Wampus Cats and partners who will review & judge all eligible Submissions. The decisions of Wampus Cats are final and binding in all matters, including interpretation and application of the rules. The Winner agrees that Wampus Cats shall have the sole and absolute discretion in determining the winning Submission & is not obligated to use the winning Submission in any way. Wampus Cats’ sole obligation under these rules shall be to award the prize to the Winner. In addition, Wampus Cats reserves the right, in its sole and absolute discretion, to declare any Submission submitted as a “winner” of the Contest and utilize any Submission as a name of a product that is sold and distributed to the public. In event that Wampus Cats utilizes a Submission in such a manner, entrant’s sole and exclusive right shall be limited to receipt from Wampus Cats the aforementioned prize. In the event more than one (1) individual submits the same Winning Submission, each individual who submitted the Submission will be declared a potential Winner and will be entitled to receive the same aforementioned prize. Wampus Cats reserves the right to select two or more entries for a runoff where the winner may be selected by a fan vote. Non-compliance shall result in disqualification and award of the prize to an alternate winner. If the potential Winner is found to be ineligible, or if he or she has not complied with these Official Rules, or declines a prize for any reason prior to award, such potential Winner may be disqualified and an alternate potential winner may be selected. The Sponsor is not responsible for and shall not be liable for late, lost, intercepted, misdirected, or unsuccessful efforts to notify the potential Winner, or if potential Winner is a minor, for late, lost, misdirected, or unsuccessful efforts of potential Winner to provide signed parental/guardian consent.
Release- By participating in the Contest, entrant agrees to release, discharge, indemnify & hold harmless Wampus Cats and its respective owners, directors, officers, employees, agents, successors and assigns (“Released Parties”) from and against any and all claims, liability, costs (including attorneys’ fees), losses, damages, fines or injuries (up to and including bodily injury and death) of any kind arising out of or related to: (i) entrants’ participation in the Contest (including travel to/from any Contest activity); (ii) any acceptance, possession, misuse or use of any prize (including, without limitation, losses, damages or injuries to entrant or any other person or other property, or to their persons, including those arising from any travel to/from any prize event or activity); (iii) the Released Parties’ violation of rights of publicity or privacy, claims of defamation or portrayal in a false light or based on any claim of infringement of intellectual property; and (iv) any typographical, human or other error in the printing, offering, selection, operation or announcement of any Contest activity and/or prize.
Publicity Release- Winner irrevocably grants Wampus Cats the right & permission to use his/her name & Submission for advertising, promotional and/or publicity purposes in connection with the Contest, in all forms of media & by any and all means and media (now and hereafter known), and on and in connection with related products, services, advertising and promotional materials (now known or hereafter developed), worldwide, in perpetuity, without any obligation, notice or consideration except for the awarding of the prize.
Suspension / Modification / Termination- In the event Wampus Cats is prevented from continuing with the contest by any event beyond its control, or any federal, state or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Disco Turkeys’ control (each a “Force Majeure” event or occurrence) Wampus Cats shall have the right to modify, suspend or terminate the Contest.
Governing Law / Limitation of Liability- All issues and questions concerning the construction, validity, interpretation and enforceability of the rules or the rights and obligations of entrants, Wampus Cats or the Released Parties in connection with the contest will be governed by and construed in accordance with the internal laws of the State of North Carolina, without giving effect to any choice of law or conflict of law rules or provisions, and all disputes will be resolved in the courts of Stanly County, North Carolina.
